Terms of Use

1. Agreement
By downloading, installing, or using AuroraWatch (the "App"), you agree to these Terms of Use and our Privacy Policy (together, the "Terms"). If you do not agree, do not use the App.
2. The service
The App provides aurora and space-weather information, maps and visualizations, optional notifications, optional community features (such as sightings), optional subscription features marketed as AuroraWatch Pro, and other features we may add, change, or discontinue over time.
We do not guarantee uninterrupted or error-free operation. Forecasts and data are provided for general information and planning; natural phenomena are inherently uncertain.
3. Accounts
You may be able to use the App with Sign in with Apple, Google, or Guest mode. You are responsible for maintaining the security of your device and for activity under your account. You must provide accurate information where required and not impersonate others.
4. Subscriptions & payments
If you purchase AuroraWatch Pro or other paid features offered through the App, payment is processed by Apple via your App Store account. Your purchase is also subject to Apple's applicable terms and policies (including terms for subscriptions and refunds). To the maximum extent permitted by law, billing, renewal, cancellation, and refund requests for App Store purchases are handled by Apple according to Apple's rules.
Subscription features, pricing, and availability may change. Pro features require an eligible non-guest account where the App requires it for subscription eligibility.
5. User content & license
If you submit content (including sightings, descriptions, images, or reports), you represent you have the rights to submit it. You grant us a worldwide, non-exclusive license to host, store, reproduce, display, and distribute your content as needed to operate, improve, and promote the App and related services (including moderation and safety).
6. Prohibited conduct
You agree not to:
- Violate applicable laws or third-party rights
- Harass, threaten, or harm others
- Upload malware, scrape or overload our systems, or attempt unauthorized access
- Misrepresent sightings, locations, or emergencies
- Circumvent subscription or technical protections
7. Intellectual property
The App, branding, and content we provide (excluding user content) are owned by us or our licensors and protected by intellectual property laws. Except for the limited right to use the App, no rights are granted.
8. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT DATA WILL BE ACCURATE OR COMPLETE OR THAT AURORA ACTIVITY WILL OCCUR.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US DIRECTLY IN THE 12 MONTHS BEFORE THE CLAIM (IF ANY) OR (B) USD $50.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted.
10. Governing law
These Terms are governed by the laws of New Zealand, without regard to conflict-of-law principles. If you are a consumer, you may have mandatory rights in your country of residence that cannot be waived.
11. Changes
We may modify these Terms by posting an updated version on this page. If changes are material, we may provide additional notice where appropriate. Continued use after the effective date constitutes acceptance of the updated Terms.
