Agreement to Terms
By accessing or using AuroraWatch ("the App"), you agree to be bound by these Terms of Service, which are governed by New Zealand law. If you disagree with any part of these terms, you may not access the App.
AuroraWatch is operated from New Zealand. These Terms are subject to New Zealand law and the jurisdiction of New Zealand courts.
Use License
Permission is granted to temporarily download one copy of AuroraWatch for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- Modify or copy the materials
- Use the materials for any commercial purpose or for any public display
- Attempt to reverse engineer any software contained in the App
- Remove any copyright or other proprietary notations from the materials
User Content
You retain ownership of any content you submit through the App, including aurora sightings and reports. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your content for the purpose of operating and promoting the App.
Prohibited Uses
You agree not to:
- Use the App in any way that violates applicable laws or regulations, including New Zealand law
- Transmit any malicious code or viruses
- Impersonate others or provide false information
- Interfere with or disrupt the App's functionality
- Collect user data without authorization
- Submit content that is defamatory, offensive, or violates the rights of others under New Zealand law
Disclaimer
The aurora forecasts and data provided by AuroraWatch are for informational purposes only. We do not guarantee the accuracy, completeness, or reliability of any forecasts or data. The App should not be used as the sole basis for making decisions regarding aurora viewing.
Limitation of Liability
To the maximum extent permitted by New Zealand law, AuroraWatch and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the App.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under New Zealand law.
Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of New Zealand. Any disputes arising out of or in connection with these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of New Zealand.
If you are a consumer, you may also have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, which cannot be excluded or limited by these Terms.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by updating the "Last updated" date. Your continued use of the App after such modifications constitutes acceptance of the updated terms.
